The Federal Fair Labor Standards Act identifies the need for companies to comply with regulations regarding how they classify independent contractors. The U.S. Department of Labor (DOL) has signed agreements with a majority of States in the Union to enforce this act. Non-compliance may result in significant fines & penalties. In addition to the assessment of heavy penalties, companies found to be non-compliant are required to display prominently on the company website – for an entire year – a notification stating that, among other things, the company "has committed a serious violation of the law by engaging in the willful misclassification of employees." (This is being referred to as the "Scarlet Letter".)
